VOW Registrant Agreement

1. Parties and purpose

This agreement is between you (the "Registrant") and Murat Sahiner, Broker, who operates the Virtual Office Website (VOW) at home6.ca through RE/MAX Realtron Realty Inc., Brokerage (the "Brokerage"). This agreement governs your access to MLS® data that MLS® rules restrict to registered users, including sold, leased, terminated, suspended and conditional listing information and listing price history ("VOW Data").

2. Consumer–broker relationship

By accepting this agreement, you enter into a lawful broker–consumer relationship with Murat Sahiner, Broker, and the Brokerage for the purpose of accessing VOW Data. This relationship does not by itself make you a client of the Brokerage and does not create a representation agreement. A client relationship requires a separate written representation agreement.

3. Registration requirements

• 3.1 You must provide your first and last name and a valid email address, and verify that email address before VOW Data is displayed.
• 3.2 You must keep your password confidential and must not allow any other person to use your account.

4. Your representations and obligations

You confirm and agree that:

• (a) you have a bona fide interest in the purchase, sale or lease of real estate of the type offered through the VOW;
• (b) you will use VOW Data only for your personal, non-commercial use;
• (c) you will not copy, redistribute, retransmit, publish, sell or otherwise use any VOW Data, except in connection with your consideration of the purchase, sale or lease of an individual property;
• (d) you will not scrape, data-mine or use automated means to collect, store, reorganize or manipulate VOW Data;
• (e) you will not assert any ownership rights of any kind in listing information or related data, including through comments or reviews.

5. Ownership of MLS® data

You acknowledge that the MLS® database, MLS® data, the PropTx MLS® System and all listing information are proprietary to PropTx, TRREB and other Member Associations, and you acknowledge the validity of their copyright. MLS® data is provided to the VOW by PropTx.

6. Compliance access

You acknowledge and agree that PropTx, TRREB, participating PropTx members, and their duly authorized representatives may access the VOW to verify compliance with MLS® rules and policies, including VOW rules, and to monitor the display of members' listings.

7. Consent to use and disclosure of personal information

You consent to the collection, use and disclosure of your personal information, including your name, email address and phone number, as described in the Privacy Policy. This includes disclosure to TRREB for auditing and legal purposes.

8. Accuracy and liability

VOW Data is deemed reliable but is not guaranteed accurate by PropTx. PropTx, TRREB and the Brokerage are not responsible or liable, directly or indirectly, for any loss or damage of any kind resulting from your use of or reliance on VOW Data, related data, or posted or linked comments or reviews. TRREB does not endorse any comments or reviews posted on the VOW.

9. Suspension and termination

The Brokerage may suspend or terminate your access to VOW Data at any time, including where required by TRREB or PropTx. When access ends, you must stop using any VOW Data you obtained.

10. Relationship to other terms

This agreement applies in addition to the Terms of Use and the Privacy Policy. If there is a conflict regarding VOW Data, this agreement prevails.
