Terms of Use

1. Acceptance

These Terms of Use ("Terms") govern your access to and use of home6.ca, including its search, map, alert, calculator and account features (the "Site"). By using the Site, with or without an account, you agree to these Terms. If you do not agree, do not use the Site.

2. Who operates the Site

The Site is operated by Murat Sahiner, Broker, a registrant with the Real Estate Council of Ontario (RECO), who provides real estate services through RE/MAX Realtron Realty Inc., Brokerage (the "Brokerage"). In these Terms, "we", "us" and "our" refer to Murat Sahiner and the Brokerage. "You" refers to any person using the Site.

Home6™ is a trademark of HomeSix Realty Inc. HomeSix Realty Inc. is not a real estate brokerage and does not trade in real estate.

3. No client relationship through Site use

Using the Site, creating an account or submitting a form does not make you a client of the Brokerage and does not create a representation agreement. A client relationship is created only through a written representation agreement with the Brokerage. Before providing services, we will give you the RECO Information Guide, which explains the difference between a client and a self-represented party. See the Agency & Brokerage Disclosure page.

4. Accounts

• 4.1 You must be at least 18 years old to create an account.
• 4.2 You must provide your real name, a valid email address and accurate information, and keep it current.
• 4.3 You must verify your email address before accessing sold, leased and other restricted MLS® data.
• 4.4 One account per person. You may not create an account on behalf of another person or a business.
• 4.5 You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at info@home6.ca if you suspect unauthorized access.
• 4.6 Access to sold and leased data is also governed by the VOW Registrant Agreement, which you accept separately at registration.

5. Permitted use of listing data

MLS® listing data on the Site is provided for your personal, non-commercial use in connection with your consideration of buying, selling or leasing real estate. The VOW Registrant Agreement sets out additional conditions that apply to registered users.

6. Prohibited uses

You may not:

• (a) scrape, crawl, data-mine or otherwise extract listing data, building data, reviews or any other Site content by automated or manual means;
• (b) copy, republish, sell, sublicense or redistribute any Site content, including MLS® data;
• (c) use Site content to train, fine-tune or evaluate machine learning or AI models;
• (d) circumvent the registration requirement for restricted data, or share your account credentials;
• (e) create accounts using false information or automated tools;
• (f) submit false, misleading or spam enquiries, showing requests or valuation requests;
• (g) interfere with the Site's security, rate limits or normal operation, or attempt to reverse engineer the Site;
• (h) use the Site in violation of any applicable law, including privacy, anti-spam and human rights laws.

We may suspend or terminate access, without notice, for any breach of this section.

7. AI features, estimates and tools

The Site includes AI-assisted search, AI-generated listing summaries, AI price estimates, a multiple offer probability score, home valuation comparables and financial calculators. These outputs are automated, may be inaccurate or incomplete, and are provided for general information only. They are not appraisals, not written opinions of value from a registrant, and not financial, mortgage, tax or legal advice. See the Disclaimers page.

8. User content

• 8.1 Registered users may submit building reviews and other content ("User Content"). User Content must comply with the Review & Content Guidelines.
• 8.2 You retain ownership of your User Content. By submitting it, you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to host, display, edit for length or formatting, and remove it on the Site and in Site-related communications.
• 8.3 All User Content is reviewed before publication. We may decline, edit or remove User Content at our discretion.
• 8.4 User Content reflects the views of its author, not ours. We do not verify statements made in User Content.

9. Communications

Communications you receive from us, and how to consent to or stop them, are described in the Privacy Policy (Section 11).

10. Intellectual property

• 10.1 The Site's design, text, software, graphics and compilations are owned by or licensed to us and are protected by Canadian and international copyright law.
• 10.2 Home6™ and the Home6 logo are trademarks of HomeSix Realty Inc.
• 10.3 MLS® listing data is proprietary to PropTx, the Toronto Regional Real Estate Board (TRREB) and other Member Associations, and is protected by copyright. See the VOW Registrant Agreement and the Copyright & Trademark Notices page.
• 10.4 MLS®, Multiple Listing Service®, REALTOR® and related marks are trademarks of The Canadian Real Estate Association (CREA). RE/MAX and related marks are trademarks of their respective owners. See the Copyright & Trademark Notices page.
• 10.5 No right or licence is granted to you except as expressly stated in these Terms.

11. Third-party services and links

The Site uses and links to third-party services, including mapping, Walk Score®, mortgage rate providers and social sign-in. We are not responsible for third-party content, availability or practices. Your use of third-party services is governed by their own terms.

12. Disclaimer of warranties

The Site and all content are provided "as is" and "as available". To the maximum extent permitted by law, we make no warranty that the Site or its content is accurate, complete, current, uninterrupted or error-free. Listing information, square footage, maintenance fees, building details and neighbourhood data must be independently verified before you rely on them.

13. Limitation of liability

To the maximum extent permitted by law, Murat Sahiner, the Brokerage, HomeSix Realty Inc., and their respective directors, employees, contractors and registrants are not liable for any indirect, incidental, consequential or punitive damages, or for any loss arising from your use of or reliance on the Site or its content.

14. Indemnity

You agree to indemnify the parties listed in Section 13 against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or your User Content.

15. Suspension and termination

We may suspend or terminate your account or access at any time for breach of these Terms or the VOW Registrant Agreement, or if required by TRREB, PropTx or the Brokerage. You may delete your account at any time from your account settings.

16. Changes

We may update these Terms. We will notify registered users by email at least 14 days before material changes take effect and update the effective date above. Continued use after the effective date means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. The courts of Ontario sitting in Toronto have exclusive jurisdiction.
